CDO on Dumaluan's bldg. held in abeyance |
The Cease and Desist Order on a building owned by Panglao Mayor Doloriech Dumaluan was held in abeyance after its owner filed a motion for reconsideration. The motion arose from the Notice of Decision and or Resolution issued by the regional office of the Department of Environment and Natural Resources dated June 21,2006 finding the proponent to have implemented a project without an Environmental Compliance Certificate (ECC). It was also found in the same decision that the Panglao mayor was also made to pay the penalty of P50,000. The fine was meted out after he was found to have violated Presidential Decree 1586 otherwise known as The Philippine Environmental Impact Statement System Act and its implementing rules and regulations. The DENR decision contradicted Dumaluan's assertion in his counter affidavit that he was issued an ECC by the DENR after its agent conducted an ocular inspection of the proposed construction. According to the complaint filed against the Panglao mayor, it was alleged that he constructed a restaurant within the 20-meter public easement in violation of existing ordinance on height restriction and of the Water Code of the Phils. In the same counter affidavit he signed, he confirmed that he constructed a restaurant in his beach resort but maintained that he did not violate any ordinance or provisions of the Water Code Of the Phils. “because the same is not within the 20-meter public easement. |
