What happens to former mayor Dumaluan's cases?

 

 

As of last report, he is facing at least five criminal cases while serving as mayor of Panglao four one term. Now, the town has a new mayor and resolution of these cases is still as elusive as ever. This prompted incumbent Mayor Benedicto Alcala to inquire from the Office of Ombudsman Merceditas Gutierrez the status of the cases filed against the former mayor. Mayor Alcala made special mention of a case of unexplained wealth filed by the Post publisher against ex-mayor Dumaluan. Under OMB-V-C-06 011-B and OMBV-A-06-V-A-06-0499-1,the Post publisher filed a case against Dumaluan for non-filing and late filing of Statement of Assets and Liabilities and Net worth (SALN). The case was filed on February 23,2006 .

Other cases filed were the Hormachuelos, etal vs Dumaluan for violation of the National Building Code, Anti-Graft Law and Conduct Unbecoming of a Public Official; Hormachuelos, etal vs Dumaluan for Perjury, Falsification, Dishonesty and Gross Misconduct; Lagumbay, etal vs Dumaluan for Grave Misconduct of Authority, Gross misconduct, Oppression and Discrimination; and Hormachuelos, etal vs Dumaluan for Malversation of Public Funds, Abuse of Authority. Earlier, lawyer Terence Fernandez, counsel of the complainants also inquired as to the present status of these cases and as to the final appropriate action undertaken by Pelagio Apostol, Ombudsman of the Visayas particularly on the unexplained wealth case.

The lawyer said considering it's significance and in the Ombudsman's sincere drive to eradicate corruption in government, his client's complaint clearly necessitates swift and decisive action. In urging the Ombudsman to take immediate action, Fernandez emphasized in his follow-up letter that a speedy resolution of these cases will impress upon all and sundry that his office is serious in fulfilling its mandate to act promptly on all complaints against officers or employees of the government and promote efficient service by the government to the people.
