What exactly is the reason why China enforced its new Air Defense Identification Zone (ADIZ) at East China Sea at this time? It not only increased tension in the region but singly changed the current condition in the East China Sea. Provoked, Japan, South Korea, and the US, continued to challenged China's new Air Defense Identification Zone. China government said it will carry out without hesitation timely countermeasures. Is China violating international law and international practice? China's new Air Defense Identification Zone overlaps with South Korea's which covers the disputed Socotra Rock. It overlaps Taiwan and covers Senkaku Islands claimed by Japan. The United States clearly regards China's new Air Defense Identification Zone a challenge, and declared to continue to support and partner with allies in the region. Will there likely be confrontations and collision in the air if the movement continues? Analysts say that China being the world's second biggest economy and Japan as the third biggest economy, both being major trading partners of each other would not really want to engage in armed conflict. Meanwhile, it is noticeable that China's navy aircraft carrier is in the South China Sea, said to conduct scientific experiments and military training. Our government expressed concerned that China might also extend control of air over the disputed Spratly Islands and Scarborough Shoal.

Juliano did not die while he was under the employ of petitioners. His contract of employment ceased when he was discharged on January 20, 2000, after having completed his contract thereat. He died on August 27, 2001 or one year, seven months and seven days after the expiration of his contract. Thus, his beneficiaries are not entitled to the death benefits under the Standard Employment Contract for Seafarers. Moreover, there is no evidence to show that Juliano's illness was acquired during the term of his employment with petitioners.
