Enerio comes out of hiding

Fugitive obtains affidavit of desistance where author declares “his family wants to move on”

 

The days of life on the run for businessman Eduardo “Boy” Enerio may be over as he was sighted on several occasions in different parts of the city “ apparently as a free man”. Although a court is yet to absolve him formally of any culpability, the controversial businessman maintained the trappings of a free man after producing an affidavit of desistance courtesy of the father who sued him for murder. Charged for a non-bailable crime of murder following the death of Jack Lord Decasa on November 15, 2009, Enerio dropped out of sight while a warrant was issued for his arrest. It was not until he obtained the affidavit of desistance from Decasa's father Jacinto, that he showed up “as if nothing had happened two years ago”. Enerio's murder case became controversial after his sworn enemies placed wanted posters offering reward money for his arrest. A prize money of P200,000 was offered for Enerio's arrest but bounty hunters failed to apprehend the elusive fugitive.

DESISTANCE

Enerio 57, is facing a crime of murder before the Regional Trial Court of Bohol, Branch 49, docketed as Criminal Case No. 14583. In his affidavit of desistance sworn in by Prosecutor Eric Ucat, the elder Decasa manifested that after several consultations with the immediate members of “my family, I have decided to desist from further prosecuting Enerio of the crime charged because we believe that he is also a victim of the circumstances surrounding the case”. Decasa said that his family wanted peace of mind and “we do not want anymore hassles and troubles attending hearings of the case. He said “we want to move on and we cannot move on if this case would still continue”. Citing that vindictiveness should give way to forgiveness, he said it was for this reason that he was no longer interested in prosecuting further the above-mentioned case adding that he and Enerio have already settled the matter among themselves. In withdrawing his charges against Enerio, Decasa said he has no more reason to pursue the case against Enerio adding that he already lost interest in testifying the case against the respondent. In signing the desistance, Decasa asked the court where Enerio was indicted for murder that the case be withdrawn or dismissed.
