Don't doctor the facts, group tells Dumaluan

 

Don't doctor the facts, a group calling itself the Justice for Vivian Dumaluan Movement (JVDM) said in a statement. JVDM issued the statement in response to the propaganda offensive launched by former Panglao Mayor Doloreich Dumaluan against people he wanted to blame for the decision of the Office of the President reversing the resolution of the Secretary of Justice (SOJ) on the rape with the controversial homicide case. “Let us not confuse the issue by resorting to diversionary tactics,” JVDM said. The group gave a narration of facts as its rebuttal to Dumaluan's attacks. “Here are the facts. Vivian Dumaluan went missing and was found dead 50 meters from the Dumaluan Beach Resort on April 20, 2004 ,” JVDM pointed out.

The group said that Dumaluan cannot deny that the rape-murder took place regardless of his quarrel with other people. JVDM said that during the election campaign in 2004 when he ran against Mayor Benedicto Alcala, Dumaluan used the crime as his main campaign issue proof of which was the video showing of the discovery of Vivian's body during the miting de avance. “We would like to remind him that in that campaign, he promised to solve the crime and boasted that he would drag the perpetrator's body around Panglao,” it added. The group said that during the investigation, Dumaluan and his brother executed affidavits that tend to influence the conduct of the probe towards a fall guy that he had in mind. Due to the outrage that his campaign generated, Dumaluan defeated Alcala in that election, the only time he ever won against Alcala.

When he assumed office, among the first acts that Dumaluan did was to throw out the investigator and the chief of police who was nearing the solution of the crime. “During the trial of the lone accused, he not only paid for the litigation expenses of the accused but in fact was present in all the hearings,” the group noted. On the other hand, JVDM said Dumaluan never visited the parents of the victim, never offered help like what he did to the accused, and no longer showed the anger that he displayed during the campaign. In the 2007 elections, Alcala turned the tables on Dumaluan by accusing him of using the crime for his political interest. Last March 5, 2008, JVDM recalled that self-confessed participant Alex Dasco executed an affidavit naming the former mayor as the mastermind of the crime and pointed to his brother, Engr. Teofredo Dumaluan, Narciso Maghamil and Romeo Lapinig as the ones who carried out the plan.

  “These are the facts of the case which Dr. Dumaluan cannot dispute no matter how he tries to muddle the issue,” the JVDM said. It also brushed aside Dumaluan's claim that the accusations are related to a land case. “The fact is that it is Dr. Dumaluan who is the common denominator in about six land cases with different land owners which shows that he is the aggressor,” the group added. JVDM said the reversal of the SOJ resolution is a providential intervention that brings hope that the case will be solved as the crime's sixth anniversary is approaching.
