The Regional Trial Court based in Loay has ruled in favor of former Alburquerque mayor Jose Ugdoracion, Jr. validating in effect his appointment as municipal councilor after he was stripped of his elected position as municipal mayor due to citizenship issue. The Commission on Elections en banc found the ex-mayor a US citizen thereby deposing him as Alburquerque mayor. The Supreme Court sustained the poll body's ruling. A court action hounded again the former mayor when he was appointed as municipal councilor replacing the vacant position left by the number eight placer who rose to become the number seven councilor.
The movement in the ranking of councilors was precipitated by the vacancy left by the ouster of Ugdoracion paving the way for the assumption of mayor former Vice Mayor Cirilo Jalad. In handing down the favorable ruling, Presiding Judge Dionisio Calibo, Jr. of RTC-Loay, dismissed the quo warranto, mandamus and damages with preliminary injunction and temporary restraining order by a certain Alberto Coming filed against Ugdoracion, Mayor Jalad, Alberto Balo and Vilma Fe Varquez. In deciding the case, the court, confirmed the earlier appointment by the PDP-Laban through its chair Senator Aquilino Pimentel, Jr. on the basis of an earlier appointment made by the party's provincial chair Provincial Board Member Cesar Thomas Lopez. The requirement for appointment of vacant position arising from death, disqualification, etc. is a recommendation from the party to a person that seeks the appointment. |
